{"id":4050,"date":"2020-11-24T11:13:32","date_gmt":"2020-11-24T11:13:32","guid":{"rendered":"https:\/\/perezdevargas.es\/?p=4050"},"modified":"2022-02-25T17:21:23","modified_gmt":"2022-02-25T17:21:23","slug":"normalizacion-de-la-viviendas-irregulares-en-el-futuro-planeamiento-general-de-marbella","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/es\/blog\/normalizacion-de-la-viviendas-irregulares-en-el-futuro-planeamiento-general-de-marbella\/","title":{"rendered":"Normalizaci\u00f3n de la viviendas irregulares en el futuro Planeamiento General de Marbella."},"content":{"rendered":"<p><strong>INCORPORACI\u00d3N DE LAS EDIFICACIONES IRREGULARES AL FUTURO PLANEAMIENTO GENERAL DE MARBELLA, EN FUNCI\u00d3N DE SU ADECUACI\u00d3N Y COMPATIBILIDAD CON EL MODELO DE CIUDAD.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>El nuevo planeamiento deber\u00e1 <strong>justificar y motivar<\/strong> la incorporaci\u00f3n de las<strong> edificaciones irregulares, <\/strong>en funci\u00f3n de la<strong> adecuaci\u00f3n y compatibilidad o no de cada edificaci\u00f3n irregular con la ordenaci\u00f3n urban\u00edstica y el modelo de ciudad,<\/strong> que se definir\u00e1n en el futuro planeamiento general.<\/p>\n<p>Como se afirma en la Memoria del Avance, en la redacci\u00f3n del futuro planeamiento general de Marbella, se deber\u00e1 tomar como punto de partida la<strong> realidad urban\u00edstica existente en el municipio y no el planeamiento preexistente de 1986,<\/strong> poniendo de manifiesto la voluntad de afrontar la problem\u00e1tica derivada de las edificaciones construidas, en contra de las determinaciones del PGOU de 1986.<\/p>\n<p>Debemos partir de los presupuestos b\u00e1sicos ya mencionados, de una parte, el <strong>objetivo principal del planeamiento es la ordenaci\u00f3n urban\u00edstica y el establecimiento del modelo de ciudad para el futuro,<\/strong> de otra parte, se deber\u00e1 proceder a <strong>la incorporaci\u00f3n de las edificaciones irregulares,<\/strong> <strong>de forma motivada y justificada, <\/strong>por supuesto, respetando la competencia que corresponde a los Tribunales que hayan dictado sentencia declarando la nulidad de las licencias, que sirvieron de base para la construcci\u00f3n de edificaciones en contra de las determinaciones del PGOU de 1986.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>INTER\u00c9S GENERAL Y SEGURIDAD JUR\u00cdDICA.-<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Todo planeamiento general trata de mejorar lo que hereda y salvar las insuficiencias derivadas de la ejecuci\u00f3n de un planeamiento anterior, y no por ello deja de ser un plan \u201cnuevo\u201d. Queremos decir que el hecho de que el motivo de la \u201corientaci\u00f3n al pasado\u201d del PGOU marbell\u00ed sea la ilegalidad de buena parte de lo construido en los a\u00f1os precedentes no deslegitima el objetivo del nuevo planeamiento, en tanto en cuanto el prop\u00f3sito regularizador responde a las necesidades actuales del municipio.<\/p>\n<p>En definitiva, ese prop\u00f3sito viene demandado por el inter\u00e9s general.<\/p>\n<p>As\u00ed las cosas, una innovaci\u00f3n de planeamiento que prevea la legalizaci\u00f3n de actuaciones irregulares deber\u00e1 realizar un esfuerzo especial por justificar que la misma responde a criterios de racionalidad y prosecuci\u00f3n del inter\u00e9s p\u00fablico urban\u00edstico, debiendo incorporar una real y exteriorizada expresi\u00f3n de los criterios y motivos que justifican la nueva ordenaci\u00f3n.<\/p>\n<p>As\u00ed pues, parece que en realidad la normalizaci\u00f3n, como prop\u00f3sito u objetivo de la de la aprobaci\u00f3n o innovaci\u00f3n del planeamiento, es admisible, si bien debe producirse en el marco de un proceso de ordenaci\u00f3n de la ciudad m\u00e1s amplio, en el que resulte acreditado que la persecuci\u00f3n del inter\u00e9s general es la finalidad primordial del nuevo planeamiento.<\/p>\n<p>El hecho de que el planeamiento centre su atenci\u00f3n en la realidad existente para procurar adecuarla a la legalidad es un objetivo leg\u00edtimo en la medida en que responda o trate de satisfacer intereses generales.<\/p>\n<p>El <strong>inter\u00e9s general<\/strong> demanda la normalizaci\u00f3n de las edificaciones irregulares, como f\u00f3rmula para recuperar la <strong>seguridad jur\u00eddica <\/strong>de Marbella, en el \u00e1mbito urban\u00edstico.<\/p>\n<p>Marbella, 24 de noviembre de
