Tribunal Constitucional ratifica la constitucionalidad de la Ley 7\/2021 (LISTA), pr\u00e1cticamente en su integridad."},"content":{"rendered":"<p>La citada ratificaci\u00f3n incluye la autorizaci\u00f3n viviendas unifamiliares aisladas no vinculadas a las actuaciones ordinarias o extraordinarias del suelo r\u00fastico.<!--more--><\/p>\n<p>A la vista de la nota informativa n\u00ba 14\/2024 del TC, debemos concluir que la regulaci\u00f3n relativa a las viviendas unifamiliares no vinculadas a las actuaciones ordinarias o extraordinarias del suelo r\u00fastico ha superado el filtro de la constitucionalidad, y por tanto, la referida regulaci\u00f3n mantiene su vigencia.<\/p>\n<p>La declaraci\u00f3n de inconstitucionalidad\u00a0 est\u00e1 referida, \u00fanica y exclusivamente, al inciso del p\u00e1rrafo primero del art\u00edculo 22.2 de la Ley 7\/2021 \u201casimismo, vinculadas a estas actuaciones, podr\u00e1n autorizarse conjuntamente edificaciones destinadas a uso residencial, debiendo garantizarse la proporcionalidad de vinculaci\u00f3n entre ambos\u201d, efectivamente, la declaraci\u00f3n de inconstitucionalidad excluye la posibilidad del uso residencial complementario a equipamientos, usos industriales, terciarios o tur\u00edsticos y cualesquiera otros que deban implantarse en suelo r\u00fastico.<\/p>\n<p>Por tanto, el p\u00e1rrafo segundo del art\u00edculo 22.2 de la referida Ley mantiene su vigencia, al no verse afectado por la declaraci\u00f3n de inconstitucionalidad, y en consecuencia, sigue en vigor la posibilidad de autorizarse <strong>viviendas unifamiliares aisladas no vinculadas a las actividades propias del suelo r\u00fastico<\/strong>, siempre que no induzcan a la formaci\u00f3n de nuevos asentamientos ni impida el normal desarrollo de los usos ordinarios del suelo r\u00fastico.<\/p>\n<p>El referido p\u00e1rrafo segundo del art\u00edculo 22.2 de la Ley ha sido desarrollado por el Reglamento, aprobado por Decreto 550\/2022.<\/p>\n<p>El art\u00edculo 31 del Reglamento establece que en suelo r\u00fastico podr\u00e1n autorizarse <strong>viviendas unifamiliares aisladas no vinculadas a las actuaciones ordinarias o extraordinarias<\/strong>, siempre que no induzcan a la formaci\u00f3n de nuevos asentamientos ni impidan el normal desarrollo de los usos ordinarios del suelo r\u00fastico.<\/p>\n<p>El art\u00edculo 32.1.c) del Reglamento establece que la implantaci\u00f3n de viviendas no vinculadas, como actuaci\u00f3n extraordinaria en suelo r\u00fastico, requiere de una autorizaci\u00f3n del Ayuntamiento previa a la licencia que cualifique los terrenos donde pretendan implantarse.<\/p>\n<p>El apartado 2 del citado art\u00edculo 32 regula el procedimiento de autorizaci\u00f3n para actuaciones extraordinarias, entre ellas, la implantaci\u00f3n de vivienda no vinculada.<\/p>\n<p>En conclusi\u00f3n, en cuanto al uso residencial en suelo r\u00fastico, la declaraci\u00f3n de inconstitucionalidad est\u00e1 referida, \u00fanica y exclusivamente, a su implantaci\u00f3n como complementario de equipamientos, usos industriales, terciarios o tur\u00edsticos y cualesquiera otros que deban implantarse en suelo r\u00fastico.<\/p>\n<p>Por supuesto, ampliaremos la informaci\u00f3n una vez que tengamos el texto de la sentencia dictada por el TC.<\/p>\n<p>&nbsp;<\/p>\n<p><span
