al pago de la Plusval\u00eda devengada al adquirir la vivienda a un Promotor\u201d.<\/i><\/p>\n<p><!--more--><\/p>\n<p>La Sala de lo Civil del Tribunal Supremo, en una previa Sentencia de 25 de noviembre de 2.011, <strong>declar\u00f3 abusiva la cl\u00e1usula contractual<\/strong> que impon\u00eda al comprador la obligaci\u00f3n de abonar la Plusval\u00eda o Impuesto Municipal sobre el Incremento del valor de los Terrenos de Naturaleza Urbana devangado por la adquisici\u00f3n de la vivienda, cuando dicha cl\u00e1usula no hab\u00eda sido pactada o negociada individualmente entre las partes.<\/p>\n<p>Pues bien, el Tribunal Supremo en su reciente Sentencia de 12 de marzo de 2.014 (Recurso de Casaci\u00f3n n\u00ba 184\/2012), y siguiendo la interpretaci\u00f3n que el Tribunal de Justicia de la Uni\u00f3n Europea realiz\u00f3 en Sentencia de 16 de enero de 2.014 (C226\/12), en relaci\u00f3n con la Directiva del Consejo 93\/12\/CEE sobre las <strong>cl\u00e1usulas abusivas<\/strong> en los contratos celebrados entre consumidores, vuelve a declarar que se produce una lesi\u00f3n jur\u00eddica del consumidor, al transferirle una deuda fiscal (plusval\u00eda) que corresponde al vendedor conforme dispone la normativa aplicable (art\u00edculo 104 Texto Refundido de la Ley Reguladora de las Haciendas Locales), ratificando en consecuencia la nulidad de dicha cl\u00e1usula contractual, y estableciendo que debe ser el promotor y vendedor quien asuma el pago de la plusval\u00eda devengada por la transmisi\u00f3n de la vivienda.<\/p>\n<p>En Estepona a 22 de
