{"id":680,"date":"2011-11-17T00:00:00","date_gmt":"2011-11-17T00:00:00","guid":{"rendered":"http:\/\/public.kiboserver.com\/perezdevargas\/la-imposiblidad-de-obtener-financiacion-bancaria-puede-justificar-la-resolucion-del-contrato-de-compraventa\/"},"modified":"2022-02-25T17:12:53","modified_gmt":"2022-02-25T17:12:53","slug":"imposiblidad-financiacion-bancaria-resolucion-contrato-compraventa","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/es\/blog\/imposiblidad-financiacion-bancaria-resolucion-contrato-compraventa\/","title":{"rendered":"La imposiblidad de obtener financiaci\u00f3n bancaria, no puede justificar la resoluci\u00f3n del contrato de compraventa."},"content":{"rendered":"<p>Dada la actual situaci\u00f3n econ\u00f3mica, venimos observando como en los \u00faltimos tiempos los <a href=\"https:\/\/perezdevargas.es\/areas\/\">compradores de viviendas<\/a> de nueva construcci\u00f3n, se est\u00e1n negando sistem\u00e1ticamente al otorgamiento de la escritura p\u00fablica de compraventa y pago del resto del precio pendiente, ello como consecuencia de las dificultades existentes a la hora de obtener financiaci\u00f3n bancaria para afrontar dicho pago, llegando incluso a instar la resoluci\u00f3n del contrato de compraventa suscrito ante los Tribunales de Justicia por dicha causa, alegando que nos encontramos ante un supuesto de fuerza mayor sobrevenida prevista en el <a href=\"http:\/\/www.enciclopedia-juridica.biz14.com\/d\/fuerza-mayor\/fuerza-mayor.htm\" target=\"_blank\" rel=\"noopener noreferrer\">art\u00edculo 1.105 del C\u00f3digo Civil.<\/a><!--more--><\/p>\n<p>Sin embargo, la reciente jurisprudencia menor considera que las dificultades o imposibilidad de obtener financiaci\u00f3n bancaria, no puede alzarse como un motivo de resoluci\u00f3n del contrato de compraventa suscrito, toda vez que la parte compradora ten\u00eda la obligaci\u00f3n y el deber de prever con antelaci\u00f3n a la firma de dicho contrato, sus posibilidades de poder cumplir en el futuro con la obligaci\u00f3n de pago asumida en virtud del contrato suscrito, por lo que tal circunstancia no puede ser considerada como un hecho imprevisible, y menos a\u00fan inevitable, ya que la falta de previsi\u00f3n del contratante, en este caso el comprador, no es subsumible dentro del concepto de fuerza mayor.<\/p>\n<p>En tal sentido se han pronunciado, entre otras muchas, las siguientes Sentencias de las Audiencias Provinciales:<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0 La Sentencia de la Audiencia Provincial de Castell\u00f3n (Secci\u00f3n 1\u00aa), de 21 de diciembre de 2.010 (JUR 2011\/77637).<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0 La Sentencia de la Audiencia Provincial de Murcia (Secci\u00f3n 4\u00aa), de 14 de octubre de 2.010 (JUR 2010\/412089).<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0 La Sentencia de la Audiencia Provincial de Ja\u00e9n (Secci\u00f3n 2\u00aa) de 19 de marzo de 2.010 (JUR 2010\/195666).<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0 La Sentencia de la Audiencia Provincial de Madrid (Secci\u00f3n 14\u00aa), de 23 de noviembre de 2.010 (JUR 2011\/79612):<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0 La Sentencia de la Audiencia Provincial de Sevilla (Secci\u00f3n 6\u00aa) de 30 de noviembre de 2010 (JUR 2011\/121880).<\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0 Las Sentencias de la Audiencia Provincial de Valencia de 10 de febrero (Secci\u00f3n 7\u00aa), 28 de junio (Secci\u00f3n 8\u00aa) y 14 de junio (Secci\u00f3n 7\u00aa) de 2010 (RJ 2010\/223160, RJ 2010\/311981 y RJ 2010\/297620, respectivamente).<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><b>\u00a0<\/b><\/p>\n<p>Fdo.
