{"id":732,"date":"2015-10-21T00:00:00","date_gmt":"2015-10-21T00:00:00","guid":{"rendered":"http:\/\/public.kiboserver.com\/perezdevargas\/nueva-ley-sobre-el-aval-y-seguro-obligatorio-de-las-cantidades-entregadas-a-cuenta-en-la-venta-de-viviendas-sobre-plano\/"},"modified":"2019-05-30T15:20:54","modified_gmt":"2019-05-30T15:20:54","slug":"ley-aval-seguro-venta-viviendas-sobre-plano","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/es\/blog\/ley-aval-seguro-venta-viviendas-sobre-plano\/","title":{"rendered":"Nueva Ley sobre el aval y seguro obligatorio de las cantidades entregadas a cuenta en la venta de viviendas sobre plano."},"content":{"rendered":"<p>\u201cLa <a href=\"https:\/\/www.boe.es\/boe\/dias\/2015\/07\/15\/pdfs\/BOE-A-2015-7897.pdf\">Ley 20\/2015<\/a>, que deroga expresamente la <a href=\"https:\/\/www.boe.es\/boe\/dias\/1968\/07\/29\/pdfs\/A11091-11092.pdf\">Ley 57\/68<\/a> y modifica la Ley de Ordenaci\u00f3n de la Edificaci\u00f3n (LOE) entrar\u00e1 en vigor el d\u00eda 1 de enero de 2016 (BOE 15\/07\/2015).\u201d<!--more--><\/p>\n<p>La referida Ley deroga expresamente la Ley 57\/1968 sobre percibo de cantidades anticipadas en la construcci\u00f3n y venta de viviendas. Por su parte, modifica la disposici\u00f3n adicional primera de la Ley de Ordenaci\u00f3n de la Edificaci\u00f3n en el sentido de regular en dicha disposici\u00f3n adicional las garant\u00edas de las cantidades entregadas a cuenta en la venta de viviendas sobre plano. Es decir, lo que hasta ahora ven\u00eda recogido en la Ley 57\/1968 pasa a estar regulado en la LOE.<\/p>\n<p>Adem\u00e1s de regular lo que hasta ahora figuraba en la Ley 57\/1968, queremos resaltar las siguientes novedades de la disposici\u00f3n adicional 1\u00aa de la LOE con respecto a la regulaci\u00f3n establecida en la Ley 57\/1968:<\/p>\n<p>&#8211; Se regulan con m\u00e1s exhaustividad los requisitos que deben reunir tanto el seguro de cauci\u00f3n como el aval con los que se garanticen las cantidades entregadas a cuenta.<\/p>\n<p>&#8211; Se establece expresamente que si \u201ctranscurrido un plazo de dos a\u00f1os, a contar desde el incumplimiento por el promotor de la obligaci\u00f3n garantizada sin que haya sido requerido por el adquirente para la rescisi\u00f3n del contrato y la devoluci\u00f3n de las cantidades anticipadas, se producir\u00e1 la caducidad del aval\u201d.<\/p>\n<p>&#8211; En la Ley 57\/1968 se establec\u00eda expresamente que tanto el contrato de seguro como el aval, unido al documento fehaciente en que se acredite la no iniciaci\u00f3n de las obras o entrega de la vivienda tendr\u00e1 car\u00e1cter ejecutivo a los efectos prevenidos en la Ley de Enjuiciamiento Civil. Es decir, que el asegurado o avalado pod\u00edan acudir a un procedimiento judicial ejecutivo, adem\u00e1s del ordinario para exigir al asegurador o avalista la entrega de las cantidades a que el cesionario tuviera derecho. Pues bien, dicha menci\u00f3n al car\u00e1cter ejecutivo del aval y el seguro ha desaparecido en la LOE. Ello implica que si el aval o seguro no est\u00e1n intervenidos por Notario, el avalado o asegurado solo podr\u00e1 reclamar al avalista o asegurador a trav\u00e9s de un procedimiento ordinario y no a
