{"id":741,"date":"2016-02-26T00:00:00","date_gmt":"2016-02-26T00:00:00","guid":{"rendered":"http:\/\/public.kiboserver.com\/perezdevargas\/la-posibilidad-de-demoler-edificaciones-en-suelo-no-urbanizable-de-especial-proteccion-segun-pot-deja-de-ser-imprescindible\/"},"modified":"2020-02-10T12:55:00","modified_gmt":"2020-02-10T12:55:00","slug":"demoler-edificaciones-suelo-no-urbanizable-deja-ser-imprescindible","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/es\/blog\/demoler-edificaciones-suelo-no-urbanizable-deja-ser-imprescindible\/","title":{"rendered":"La posibilidad de demoler edificaciones en suelo no urbanizable de especial protecci\u00f3n seg\u00fan POT, deja de ser imprescriptible."},"content":{"rendered":"<p>El TSJ de Andaluc\u00eda ha acordado anular la orden de demolici\u00f3n de una vivienda unifamiliar en suelo no urbanizable de especial protecci\u00f3n en virtud del POT.<!--more--><\/p>\n<p>La sentencia fue notificada el pasado 18 de enero, es firme y ha sido dictada en el marco de un recurso de apelaci\u00f3n dirigido jur\u00eddicamente por nuestro Despacho.<\/p>\n<p>En primera instancia, el Juzgado de lo Contencioso- Administrativo\u00a0 n\u00ba 5 de M\u00e1laga confirm\u00f3 la orden de demolici\u00f3n dictada por el Excmo. Ayuntamiento de Casares, al considerar que la protecci\u00f3n de inter\u00e9s territorial imped\u00eda establecer l\u00edmite temporal alguno al ejercicio de la potestad de protecci\u00f3n de la legalidad; y que, por tanto, proced\u00eda ordenar la demolici\u00f3n de la vivienda, a pesar de que su antig\u00fcedad fuese superior a 4 a\u00f1os (plazo de caducidad establecido por el art. 185.1 LOUA y que, tras la reforma operada por la Ley 2\/2012 del 30 de enero, se increment\u00f3 a 6 a\u00f1os).<\/p>\n<p>Sin embargo, el TSJ de Andaluc\u00eda ha estimado \u00edntegramente el recurso de apelaci\u00f3n, revocado la sentencia y anulado la orden de demolici\u00f3n, al considerar que la declaraci\u00f3n de nulidad del POT, y de las protecciones derivadas de \u00e9ste, acordadas por la Sentencia de 6 de octubre del 2015 del Tribunal Supremo, tiene efectos retroactivos y \u201cerga omnes\u201d; de manera que <em>\u201cdebemos considerar restablecido el plazo de caducidad de cuatro a\u00f1os previsto en el art. 185.1 LOUA por lo que debe declararse que la obra realizada por el recurrente habr\u00eda efectivamente caducado\u201d.<\/em><\/p>\n<p>Por tanto, siguiendo este criterio del TSJ de Andaluc\u00eda, un gran n\u00famero de viviendas construidas en suelo no urbanizable y que pod\u00edan ser demolidas sin l\u00edmite temporal alguno, por encontrarse afectadas por la protecciones especiales derivadas del POT, pasar\u00edan a encontrarse en un r\u00e9gimen jur\u00eddico de asimilado a fuera de ordenaci\u00f3n, es decir, ser\u00edan\u00a0 contrarias al ordenamiento jur\u00eddico y carecer\u00edan de licencia urban\u00edstica, pero, como consecuencia de su antig\u00fcedad, no podr\u00edan ser sometidas acordada su demolici\u00f3n.<\/p>\n<p>La aprobaci\u00f3n de un nuevo POT no afectar\u00eda a las referidas edificaciones, puesto que la potestad de protecci\u00f3n de la legalidad y restablecimiento de la Administraci\u00f3n ya habr\u00eda caducado.<\/p>\n<p>Los<span style=\"color: #000080;\"><a style=\"color: #000080;\" href=\"https:\/\/www.diariosur.es\/marbella-estepona\/201602\/18\/tsja-anula-demolicion-vivienda-20160218010613-v.html\"> medios de comunicaci\u00f3n<\/a> <\/span>se han hecho eco de la antedicha resoluci\u00f3n judicial por su trascendencia pr\u00e1ctica para las edificaciones ilegales en la situaci\u00f3n anteriormente descrita.<\/p>\n<p>Estepona, 26 de febrero del
