{"id":6217,"date":"2021-05-20T09:04:28","date_gmt":"2021-05-20T09:04:28","guid":{"rendered":"https:\/\/perezdevargas.es\/?p=6217"},"modified":"2022-02-25T17:38:08","modified_gmt":"2022-02-25T17:38:08","slug":"la-tenue-dassemblees-de-proprietaires-dans-le-regime-horizontal-de-propriete-suite-au-rdl-8-2021-du-4-mai","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/fr\/blog\/la-tenue-dassemblees-de-proprietaires-dans-le-regime-horizontal-de-propriete-suite-au-rdl-8-2021-du-4-mai\/","title":{"rendered":"La tenue d&rsquo;assembl\u00e9es de propri\u00e9taires dans le r\u00e9gime horizontal de propri\u00e9t\u00e9 suite au RDL 8\/2021, du 4 mai."},"content":{"rendered":"<p>Le 25 octobre 2020, le d\u00e9cret royal 926\/2020 du 25 octobre 2020 est entr\u00e9 en vigueur, d\u00e9clarant l&rsquo;\u00e9tat d&rsquo;alarme pour contenir la propagation des infections caus\u00e9es par le SRAS-CoV-2, que nous connaissons tous et dont nous avons n\u00e9cessairement souffert.<\/p>\n<p>Eh bien, la validit\u00e9 de cet \u00e9tat d&rsquo;alerte a \u00e9t\u00e9 prolong\u00e9e jusqu&rsquo;au 9 mai 2021 \u00e0 00h00 par le d\u00e9cret royal 956\/2020, du 3 novembre, prorogeant l&rsquo;\u00e9tat d&rsquo;alerte d\u00e9clar\u00e9 par le d\u00e9cret royal 926\/2020, du 25 octobre, pr\u00e9cit\u00e9 ; autrement dit, \u00e0 partir du 9 mai 2021, l&rsquo;\u00e9tat d&rsquo;alerte cessera d&rsquo;\u00eatre en vigueur, ainsi que toutes les mesures \u00e9mises par les autorit\u00e9s comp\u00e9tentes dans le cadre de cet \u00e9tat d&rsquo;alerte.<\/p>\n<p>Compte tenu de ce qui pr\u00e9c\u00e8de, le d\u00e9cret-loi royal 8\/2021, du 4 mai, a \u00e9t\u00e9 promulgu\u00e9, adoptant des mesures sanitaires, sociales et juridictionnelles urgentes, \u00e0 appliquer apr\u00e8s la fin de l&rsquo;\u00e9tat d&rsquo;alarme d\u00e9clar\u00e9 par le d\u00e9cret royal 926\/2020, qui contient certaines r\u00e9glementations affectant la forme d&rsquo;adoption de nouvelles mesures de contr\u00f4le sanitaire, ainsi que d&rsquo;autres questions connexes, celles qui seront discut\u00e9es ici \u00e9tant les mesures extraordinaires applicables aux assembl\u00e9es de copropri\u00e9taires.<\/p>\n<p>Dans ce sens, logiquement, en raison de la pand\u00e9mie et des mesures adopt\u00e9es, les r\u00e9unions obligatoires n&rsquo;ont pas eu lieu dans les communaut\u00e9s de propri\u00e9taires en raison des limitations qui existent pour les tenir en personne et des doutes sur la possibilit\u00e9 d&rsquo;adopter des accords par voie t\u00e9l\u00e9matique, \u00e9tant donn\u00e9 que la loi 49\/1960, du 21 juillet, sur la propri\u00e9t\u00e9 horizontale, ne pr\u00e9voit pas la possibilit\u00e9 de tenir des r\u00e9unions \u00e0 distance.<\/p>\n<p>Ainsi, afin de pallier cette situation caus\u00e9e par les mesures sanitaires, en premier lieu, l&rsquo;article 2 du d\u00e9cret-loi royal 8\/2021 a suspendu jusqu&rsquo;au 31 d\u00e9cembre 2021 l&rsquo;obligation de convoquer et de tenir l&rsquo;assembl\u00e9e des propri\u00e9taires dans les communaut\u00e9s soumises au r\u00e9gime horizontal de propri\u00e9t\u00e9, ainsi que les obligations d&rsquo;approuver le plan de recettes et de d\u00e9penses pr\u00e9visibles, les comptes et le budget annuel, le dernier budget et les organes de direction \u00e9tant compris comme ayant \u00e9t\u00e9 prorog\u00e9s jusqu&rsquo;\u00e0 la tenue d&rsquo;une nouvelle assembl\u00e9e.<\/p>\n<p>En second lieu, toutefois, l&rsquo;article 3, par exception aux dispositions de l&rsquo;article 2 relatives \u00e0 l&rsquo;ajournement, permet que, dans certains cas, l&rsquo;assembl\u00e9e puisse se tenir par vid\u00e9oconf\u00e9rence ou par conf\u00e9rence t\u00e9l\u00e9phonique multiple, \u00e0 condition que tous les propri\u00e9taires disposent des moyens n\u00e9cessaires, et il est \u00e9galement possible d&rsquo;adopter une r\u00e9solution sans tenir d&rsquo;assembl\u00e9e par le biais d&rsquo;un vote par correspondance ou d&rsquo;une communication t\u00e9l\u00e9matique.<\/p>\n<p>Plus pr\u00e9cis\u00e9ment, \u00e0 la demande du pr\u00e9sident ou d&rsquo;un quart des propri\u00e9taires, ou d&rsquo;un nombre de propri\u00e9taires repr\u00e9sentant au moins 25 % des quotas de participation, s&rsquo;il est n\u00e9cessaire d&rsquo;adopter une r\u00e9solution qui ne peut \u00eatre report\u00e9e jusqu&rsquo;au 31 d\u00e9cembre 2021 (par exemple : r\u00e9solutions concernant les travaux, actions et installations vis\u00e9s \u00e0 l&rsquo;article 10. 1.b de la loi 49\/1960), l&rsquo;assembl\u00e9e des propri\u00e9taires peut se r\u00e9unir et se tenir en personne lorsque les mesures de s\u00e9curit\u00e9 appropri\u00e9es sont garanties, conform\u00e9ment \u00e0 l&rsquo;article 3, section 4, ou par les moyens t\u00e9l\u00e9matiques susmentionn\u00e9s.<\/p>\n<p>En tout cas, comme on l&rsquo;a d\u00e9j\u00e0 dit, selon l&rsquo;article 3, alin\u00e9a 2, l&rsquo;assembl\u00e9e des copropri\u00e9taires peut se tenir par vid\u00e9oconf\u00e9rence ou par conf\u00e9rence t\u00e9l\u00e9phonique multiple, \u00e0 condition que tous les copropri\u00e9taires disposent des moyens n\u00e9cessaires (l&rsquo;administrateur \u00e9tant responsable du respect de cette exigence), que le secr\u00e9taire reconnaisse l&rsquo;identit\u00e9 des participants \u00e0 la r\u00e9union et l&rsquo;indique dans le proc\u00e8s-verbal, l&rsquo;adresse de la r\u00e9union \u00e9tant consid\u00e9r\u00e9e, pour des raisons formelles, comme celle o\u00f9 se trouve le secr\u00e9taire ou l&rsquo;administrateur secr\u00e9taire.<\/p>\n<p>En outre, conform\u00e9ment \u00e0 la section trois de l&rsquo;article 3, il est \u00e9galement possible d&rsquo;adopter la r\u00e9solution sans tenir de r\u00e9union au moyen d&rsquo;un vote par correspondance ou d&rsquo;une autre communication t\u00e9l\u00e9matique, \u00e0 condition que les garanties de participation de tous les propri\u00e9taires, d&rsquo;identit\u00e9 de l&rsquo;exp\u00e9diteur et de r\u00e9ception de la communication puissent \u00eatre respect\u00e9es. Dans ce cas, le pr\u00e9sident de la communaut\u00e9 demande le vote de tous les propri\u00e9taires par \u00e9crit, en indiquant la date, l&rsquo;objet du vote (qui doit \u00eatre clairement exprim\u00e9), l&rsquo;adresse ou les adresses autoris\u00e9es pour l&rsquo;envoi du vote et le d\u00e9lai pour exprimer le vote, qui est de 10 jours civils. Comme dans le cas pr\u00e9c\u00e9dent, pour des raisons formelles, la r\u00e9solution est consid\u00e9r\u00e9e comme adopt\u00e9e \u00e0 l&rsquo;adresse o\u00f9 se trouve le secr\u00e9taire ou le secr\u00e9taire administrateur, bien que la date soit celle du dernier jour de la p\u00e9riode \u00e9tablie pour le vote, tandis que l&rsquo;heure d&rsquo;ouverture de la r\u00e9union est celle de la demande de vote par le pr\u00e9sident.<\/p>\n<p>Enfin, en ce qui concerne les moyens sp\u00e9cifi\u00e9s, en application de l&rsquo;article 18 de la loi sur la propri\u00e9t\u00e9 horizontale, le non-respect des garanties de participation et d&rsquo;identification qui y sont \u00e9tablies sera un motif de contestation des r\u00e9solutions adopt\u00e9es par vid\u00e9oconf\u00e9rence, par conf\u00e9rence t\u00e9l\u00e9phonique multiple ou par courrier postal ou autres moyens t\u00e9l\u00e9matiques. Conform\u00e9ment au pr\u00e9cepte susmentionn\u00e9, en r\u00e8gle g\u00e9n\u00e9rale, la contestation doit \u00eatre faite dans un d\u00e9lai de trois mois \u00e0 compter de la date formelle d&rsquo;adoption de la r\u00e9solution par le propri\u00e9taire concern\u00e9 qui est \u00e0 jour de ses paiements.<\/p>\n<p>En r\u00e9sum\u00e9, il serait souhaitable et m\u00eame n\u00e9cessaire d&rsquo;\u00e9tablir au pr\u00e9alable des protocoles d&rsquo;action pour la tenue de ce type de r\u00e9unions t\u00e9l\u00e9matiques, afin de prot\u00e9ger les droits des diff\u00e9rents
