{"id":68437,"date":"2025-12-29T17:53:43","date_gmt":"2025-12-29T17:53:43","guid":{"rendered":"https:\/\/perezdevargas.es\/?p=68437"},"modified":"2026-02-17T11:26:41","modified_gmt":"2026-02-17T11:26:41","slug":"registre-agents-immobiliers-andalousie-loi-logement","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/fr\/blog\/registre-agents-immobiliers-andalousie-loi-logement\/","title":{"rendered":"Notes sur l&rsquo;enregistrement des agents immobiliers conform\u00e9ment \u00e0 la nouvelle loisur le logement en Andalousie"},"content":{"rendered":"\n<p>Le 24 d\u00e9cembre dernier, la <strong>loi 5\/2025 du 16 d\u00e9cembre relative au logement en Andalousie<\/strong> a \u00e9t\u00e9 publi\u00e9e au Journal officiel de la Junta de Andaluc\u00eda (BOJA), dans le but de r\u00e9pondre aux besoins actuels du march\u00e9 dans la r\u00e9gion andalouse.<\/p>\n\n\n\n<p>Le <strong>Registre des agents immobiliers sp\u00e9cialis\u00e9s dans le secteur r\u00e9sidentiel<\/strong> (ci-apr\u00e8s d\u00e9nomm\u00e9 <strong>\u00ab le Registre \u00bb<\/strong>) est r\u00e9gi par le <strong>chapitre III<\/strong>, intitul\u00e9 \u00ab Interm\u00e9diation immobili\u00e8re sur le march\u00e9 r\u00e9sidentiel \u00bb, du <strong>titre IV<\/strong>, intitul\u00e9 \u00ab Mesures visant \u00e0 garantir la bonne utilisation et l&rsquo;\u00e9quilibre du march\u00e9 r\u00e9sidentiel \u00bb.<\/p>\n\n\n\n<p>Nous soulignerons ci-dessous les aspects que nous consid\u00e9rons comme les plus pertinents de cette nouvelle r\u00e9glementation, sous forme de questions-r\u00e9ponses :<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Quand le Registre entrera-t-il en vigueur ?<\/h3>\n\n\n\n<p>Dans un d\u00e9lai maximum de deux ans \u00e0 compter de l&rsquo;entr\u00e9e en vigueur de la pr\u00e9sente loi, le minist\u00e8re r\u00e9gional comp\u00e9tent en mati\u00e8re de logement prendra les mesures n\u00e9cessaires pour la cr\u00e9ation, la r\u00e9glementation et la mise en service du Registre (septi\u00e8me disposition finale).<\/p>\n\n\n\n<p>\u00c9tant donn\u00e9 que la nouvelle loi sur le logement entrera en vigueur le <strong>24 janvier 2026<\/strong>, le Registre devrait \u00eatre op\u00e9rationnel avant le <strong>24 janvier 2028<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Quel est l&rsquo;objectif fondamental du Registre ?<\/h3>\n\n\n\n<p>Favoriser la transparence dans le secteur du march\u00e9 immobilier r\u00e9sidentiel, en stimulant la professionnalisation des services d&rsquo;interm\u00e9diation immobili\u00e8re en Andalousie et en garantissant la protection des consommateurs gr\u00e2ce \u00e0 la prestation de services immobiliers de qualit\u00e9 (art. 50.2).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">L&rsquo;inscription \u00e0 ce Registre sera-t-elle obligatoire ou facultative ?<\/h3>\n\n\n\n<p>Nous estimons que le libell\u00e9 de l&rsquo;article 50.3 ne laisse aucun doute :<\/p>\n\n\n\n<p><em>\u00ab L&rsquo;inscription au Registre sera une condition n\u00e9cessaire \u00e0 l&rsquo;exercice de l&rsquo;activit\u00e9 dans la Communaut\u00e9 autonome d&rsquo;Andalousie \u00bb.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Une approbation ult\u00e9rieure d&rsquo;un r\u00e8glement r\u00e9gissant en d\u00e9tail le Registre est-elle n\u00e9cessaire ?<\/h3>\n\n\n\n<p>Oui, la loi sur le logement ordonne sa cr\u00e9ation par le minist\u00e8re r\u00e9gional comp\u00e9tent en mati\u00e8re de logement, afin qu&rsquo;il soit d\u00e9velopp\u00e9 par un futur r\u00e8glement qui d\u00e9terminera ses r\u00e8gles d&rsquo;organisation et de fonctionnement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Savons-nous comment demander l&rsquo;inscription ?<\/h3>\n\n\n\n<p>Oui. La r\u00e9glementation en la mati\u00e8re figure \u00e0 l&rsquo;article 51 :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Demande :<\/strong> d\u00e9claration sur l&rsquo;honneur.<\/li>\n\n\n\n<li>L&rsquo;inscription devra \u00eatre renouvel\u00e9e p\u00e9riodiquement, ce qui sera \u00e9galement d\u00e9termin\u00e9 par voie r\u00e9glementaire.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Connaissons-nous les conditions minimales l\u00e9gales requises pour obtenir l&rsquo;inscription ?<\/h3>\n\n\n\n<p>Oui. La loi sur le logement approuv\u00e9e, dans son article 52, exige le respect de quatre conditions :<\/p>\n\n\n\n<p><strong>1. En mati\u00e8re de formation ou de dipl\u00f4me, les conditions suivantes doivent \u00eatre remplies :<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a) \u00catre titulaire d&rsquo;un dipl\u00f4me officiel d&rsquo;agent immobilier d\u00e9livr\u00e9 par le minist\u00e8re comp\u00e9tent.<\/li>\n\n\n\n<li>b) \u00catre titulaire d&rsquo;un dipl\u00f4me universitaire dans le domaine des sciences sociales et juridiques, de l&rsquo;ing\u00e9nierie ou de l&rsquo;architecture.<\/li>\n\n\n\n<li>c) Avoir une exp\u00e9rience dans la prestation des services qui constituent l&rsquo;activit\u00e9 d&rsquo;un agent immobilier pendant au moins les quatre ann\u00e9es pr\u00e9c\u00e9dant imm\u00e9diatement la date de d\u00e9p\u00f4t de la demande. Cette exp\u00e9rience doit \u00eatre attest\u00e9e par le rapport sur la carri\u00e8re professionnelle du travailleur, qui certifie son engagement dans le secteur immobilier, son inscription au r\u00e9gime des travailleurs ind\u00e9pendants ou son contrat de franchise dans le domaine immobilier en vigueur au cours de ces quatre ann\u00e9es.<\/li>\n\n\n\n<li>d) \u00catre membre de l&rsquo;un des ordres professionnels des agents immobiliers.<\/li>\n<\/ul>\n\n\n\n<p>Dans le cas des personnes morales, au moins l&rsquo;un des administrateurs ou, le cas \u00e9ch\u00e9ant, un membre du conseil d&rsquo;administration de la soci\u00e9t\u00e9, ainsi que la personne responsable de l&rsquo;\u00e9tablissement ouvert au public, doivent remplir les conditions requises.<\/p>\n\n\n\n<p>Nous consid\u00e9rons que, pour satisfaire \u00e0 ce premier crit\u00e8re de dipl\u00f4me ou de formation, il suffirait que l&rsquo;une des quatre conditions d\u00e9crites ci-dessus soit remplie.<\/p>\n\n\n\n<p><strong>2. En ce qui concerne la sp\u00e9cialisation :<\/strong><\/p>\n\n\n\n<p>De m\u00eame, le titulaire de l&rsquo;activit\u00e9 et 50 % de ses employ\u00e9s salari\u00e9s doivent poss\u00e9der une sp\u00e9cialisation en mati\u00e8re d&rsquo;interm\u00e9diation, de conseil et de gestion sur le march\u00e9 immobilier r\u00e9sidentiel et en mati\u00e8re de logement social, attest\u00e9e par une formation officielle d&rsquo;au moins 100 heures dans ces domaines, obtenue au maximum dans les quatre ann\u00e9es pr\u00e9c\u00e9dant imm\u00e9diatement la date de pr\u00e9sentation de la d\u00e9claration responsable.<\/p>\n\n\n\n<p><strong>3. Garantie financi\u00e8re ou assurance :<\/strong><\/p>\n\n\n\n<p>Une garantie financi\u00e8re doit \u00eatre constitu\u00e9e ou une assurance de responsabilit\u00e9 civile professionnelle doit \u00eatre souscrite conform\u00e9ment \u00e0 la loi, dont les conditions seront pr\u00e9cis\u00e9es par voie r\u00e9glementaire.<\/p>\n\n\n\n<p><strong>4. Absence de casier judiciaire :<\/strong><\/p>\n\n\n\n<p>Les personnes physiques et morales ne doivent pas avoir de casier judiciaire li\u00e9 \u00e0 l&rsquo;interm\u00e9diation immobili\u00e8re dans l&rsquo;exercice de leur activit\u00e9 professionnelle.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Conclusions :<\/h3>\n\n\n\n<p>Comme nous l&rsquo;avons vu, l&rsquo;esprit de la norme est de favoriser la professionnalisation et la transparence de l&rsquo;activit\u00e9 d&rsquo;interm\u00e9diation immobili\u00e8re, ainsi que la protection des consommateurs, ce qui ne peut avoir qu&rsquo;une incidence positive pour le secteur immobilier r\u00e9sidentiel.<\/p>\n\n\n\n<p>Si la r\u00e9glementation d\u00e9taill\u00e9e de l&rsquo;organisation et du fonctionnement du Registre, ainsi que sa cr\u00e9ation m\u00eame, sont report\u00e9es, cela n&#8217;emp\u00eache pas la loi sur le logement de r\u00e9glementer et d&rsquo;anticiper des aspects importants tels que l&rsquo;obligation d&rsquo;inscription, les conditions minimales pour l&rsquo;obtenir ou la mani\u00e8re de la demander.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le 24 d\u00e9cembre dernier, la loi 5\/2025
