Compte tenu de l&rsquo;importance de certains aspects de cette proposition de loi et de son impact potentiel sur le march\u00e9 immobilier espagnol, nous estimons n\u00e9cessaire d&rsquo;en pr\u00e9senter un r\u00e9sum\u00e9 dans la pr\u00e9sente note :<\/span><\/p>\n<p>1.- <span style=\"font-weight: 400;\">Imp\u00f4t compl\u00e9mentaire d&rsquo;\u00c9tat sur la transmission de biens immobiliers \u00e0 des non-r\u00e9sidents de l&rsquo;Union europ\u00e9enne.<\/span><\/p>\n<p>1.1.- <span style=\"font-weight: 400;\">Il est pr\u00e9vu de cr\u00e9er une nouvelle taxe d&rsquo;\u00c9tat qui frappera les transmissions \u00e0 titre on\u00e9reux de biens immobiliers \u00e0 des personnes non r\u00e9sidentes dans l&rsquo;Union europ\u00e9enne. La taxe ne s&rsquo;applique pas aux premi\u00e8res transmissions, qui sont soumises \u00e0 la TVA et ne sont pas exon\u00e9r\u00e9es.<\/span><\/p>\n<p>1.2.- <span style=\"font-weight: 400;\">Le montant de l&rsquo;imp\u00f4t sera constitu\u00e9 du r\u00e9sultat de l&rsquo;application du taux de 100 % au prix de la transmission (ou \u00e0 la valeur de r\u00e9f\u00e9rence, si celle-ci est sup\u00e9rieure au prix). Ainsi, dans le cas d&rsquo;une vente o\u00f9, par exemple, l&rsquo;acheteur est une personne r\u00e9sidant au Royaume-Uni ou aux \u00c9tats-Unis et o\u00f9 le prix s&rsquo;\u00e9l\u00e8ve \u00e0 500 000,00 \u20ac, le montant de la taxe sera de 500 000,00 \u20ac.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Il ne fait aucun doute que la cr\u00e9ation de la taxe compl\u00e9mentaire propos\u00e9e aurait un impact extr\u00eamement n\u00e9gatif sur le march\u00e9 immobilier espagnol, sans pr\u00e9judice du fait qu&rsquo;un taux d&rsquo;imposition de 100 % pourrait \u00eatre consid\u00e9r\u00e9 comme confiscatoire et donc inconstitutionnel.<\/span><\/p>\n<p>2.- <span style=\"font-weight: 400;\">Imposition des locations touristiques dans le cadre de la taxe sur la valeur ajout\u00e9e (TVA).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Actuellement, les locations touristiques sont exon\u00e9r\u00e9es de TVA, sauf si elles fournissent des services propres \u00e0 l&rsquo;industrie h\u00f4teli\u00e8re. Or, le projet de loi vise \u00e0 supprimer l&rsquo;exon\u00e9ration de TVA pour toutes les locations de moins de 30 nuits situ\u00e9es dans des communes \u00ab dont la population est \u00e9gale ou sup\u00e9rieure \u00e0 10 000 habitants \u00bb, que ces services h\u00f4teliers soient fournis ou non. Le taux d&rsquo;imposition serait de 21 %.<\/span><\/p>\n<p>3.- <span style=\"font-weight: 400;\">Augmentation du taux applicable \u00e0 l&rsquo;imputation de l&rsquo;utilisation des r\u00e9sidences secondaires.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Actuellement, les personnes physiques non r\u00e9sidentes et r\u00e9sidentes sont impos\u00e9es sur le rendement pr\u00e9sum\u00e9 des biens immobiliers autres que leur r\u00e9sidence habituelle qui ne sont pas lou\u00e9s, et ce rendement est quantifi\u00e9 \u00e0 2 % de la valeur cadastrale, ou \u00e0 1,1 % de celle-ci, si celle-ci a \u00e9t\u00e9 fix\u00e9e au cours des dix p\u00e9riodes fiscales pr\u00e9c\u00e9dant le moment o\u00f9 le revenu doit \u00eatre imput\u00e9.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Or, avec la r\u00e8gle propos\u00e9e, il faudrait additionner la valeur cadastrale des biens immobiliers autres que la r\u00e9sidence habituelle dont une personne est propri\u00e9taire et appliquer le pourcentage \u00e9tabli dans le bar\u00e8me. Ainsi, jusqu&rsquo;\u00e0 une somme de valeurs cadastrales de 100 000 \u20ac, le taux de 1,1 % s&rsquo;appliquerait ; jusqu&rsquo;\u00e0 500 000,00 \u20ac, le taux de 1,5 % s&rsquo;appliquerait ; jusqu&rsquo;\u00e0 1 000 000,00 \u20ac, le taux de 2 % s&rsquo;appliquerait et \u00e0 partir de 1 000 000 \u20ac, le taux de 3 % s&rsquo;appliquerait. Le r\u00e9sultat de l&rsquo;application des pourcentages indiqu\u00e9s aux sommes des valeurs cadastrales correspond \u00e0 la base imposable, \u00e0 laquelle il faudrait appliquer le taux de 19 %, ou 24 % si le contribuable n&rsquo;est pas r\u00e9sident de l&rsquo;Union europ\u00e9enne.<\/span><\/p>\n<p>4.- <span style=\"font-weight: 400;\">Une s\u00e9rie d&rsquo;incitations fiscales sont mises en place dans le but d&rsquo;encourager la location de logements (longue dur\u00e9e).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La pr\u00e9sentation du projet de loi au Congr\u00e8s des d\u00e9put\u00e9s marque le d\u00e9but de son examen parlementaire, et pour qu&rsquo;il soit approuv\u00e9, le groupe parlementaire socialiste doit obtenir les soutiens parlementaires n\u00e9cessaires. Nous estimons que l&rsquo;imp\u00f4t compl\u00e9mentaire est confiscatoire et discriminatoire, et donc inconstitutionnel.
