{"id":68460,"date":"2024-10-23T18:26:24","date_gmt":"2024-10-23T18:26:24","guid":{"rendered":"https:\/\/perezdevargas.es\/?p=68460"},"modified":"2026-02-18T12:56:58","modified_gmt":"2026-02-18T12:56:58","slug":"cour-supreme-interdiction-locations-touristiques-espagne-2024","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/fr\/blog\/cour-supreme-interdiction-locations-touristiques-espagne-2024\/","title":{"rendered":"La Cour supr\u00eame autorise l&rsquo;interdiction des locations touristiques (AT) \u00e0 la majorit\u00e9 double des trois cinqui\u00e8mes de la communaut\u00e9 des propri\u00e9taires."},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p><strong>La majorit\u00e9 des trois cinqui\u00e8mes pr\u00e9vue par la loi sur la propri\u00e9t\u00e9 horizontale dans son article 17.12, requise pour d\u00e9cider de la limitation des locations touristiques, inclut la possibilit\u00e9 d&rsquo;interdire cette activit\u00e9, suite \u00e0 <a href=\"https:\/\/perezdevargas.es\/wp-content\/uploads\/2024\/10\/STS-1232.2024-3-DE-OCTUBRE.pdf\">l&rsquo;arr\u00eat de la Cour supr\u00eame n\u00b0 1232\/2024 du 3 octobre 2024.<\/a><\/strong><\/p>\n\n\n\n<p>Pour statuer sur le cas d&rsquo;esp\u00e8ce, qui consistait \u00e0 d\u00e9terminer si l&rsquo;accord du 20 avril 2020 d&rsquo;une communaut\u00e9 de propri\u00e9taires interdisant les locations touristiques dans ladite communaut\u00e9, sur la base de l&rsquo;article 17.12 de la LPH, \u00e9tait valide, la Haute Cour a analys\u00e9 la r\u00e9daction et la port\u00e9e dudit article.<\/p>\n\n\n\n<p>L&rsquo;article 17.12 de la LPH, r\u00e9form\u00e9 en 2019, stipule ce qui suit : <em>\u00ab La d\u00e9cision limitant ou conditionnant l&rsquo;exercice de l&rsquo;activit\u00e9 vis\u00e9e \u00e0 l&rsquo;article 5, lettre e), de la loi 29\/1994 du 24 novembre sur les baux urbains, dans les termes \u00e9tablis par la r\u00e9glementation sectorielle du tourisme, qu&rsquo;il implique ou non une modification du titre constitutif ou des statuts, requiert le vote favorable des trois cinqui\u00e8mes du total des propri\u00e9taires qui, \u00e0 leur tour, repr\u00e9sentent les trois cinqui\u00e8mes des quotes-parts de participation [&#8230;] \u00bb.<\/em><\/p>\n\n\n\n<p>Jusqu&rsquo;\u00e0 pr\u00e9sent, la jurisprudence mineure des cours provinciales s&rsquo;\u00e9tait prononc\u00e9e de mani\u00e8re contradictoire en interpr\u00e9tant les termes \u00ab limite ou conditionne \u00bb de cette disposition. Une partie de la jurisprudence a interpr\u00e9t\u00e9 cette disposition comme autorisant l&rsquo;introduction de conditions ou de limitations \u00e0 l&rsquo;exercice de l&rsquo;activit\u00e9 de location saisonni\u00e8re, mais ne permettant pas son interdiction ; une autre partie a estim\u00e9 que cette activit\u00e9 pouvait \u00eatre interdite sur la base de la disposition mentionn\u00e9e.<\/p>\n\n\n\n<p>La Cour supr\u00eame s&rsquo;est concentr\u00e9e sur l&rsquo;expression <em>\u00ab limite ou condition \u00bb <\/em>de l&rsquo;article 17.12 de la LPH afin de trancher la question controvers\u00e9e. Ainsi, la Cour supr\u00eame a principalement \u00e9tabli trois arguments pour \u00e9tayer sa d\u00e9cision :<\/p>\n\n\n\n<p><strong>1.-<\/strong> En proc\u00e9dant \u00e0 une interpr\u00e9tation t\u00e9l\u00e9ologique ou finaliste de la norme. En d&rsquo;autres termes, la Haute Cour estime qu&rsquo;il faut se r\u00e9f\u00e9rer \u00e0 l&rsquo;objectif poursuivi par la norme qui a introduit le paragraphe 17.12 de la LPH. Il s&rsquo;agit du d\u00e9cret-loi royal 7\/2019 du 1er mars sur les mesures urgentes en mati\u00e8re de logement et de location. Concr\u00e8tement, la Cour se concentre sur l&rsquo;expos\u00e9 des motifs de cette norme, dont il ressort que le l\u00e9gislateur est favorable \u00e0 la location r\u00e9sidentielle plut\u00f4t qu&rsquo;\u00e0 la location touristique, afin d&rsquo;augmenter le parc immobilier, tant pour la vente que pour la location r\u00e9sidentielle, dans le but de r\u00e9duire les prix. Par cons\u00e9quent, et compte tenu de ce qui pr\u00e9c\u00e8de concernant l&rsquo;objectif poursuivi par la loi, la Cour supr\u00eame estime que l&rsquo;interpr\u00e9tation de <em>\u00ab limiter \u00bb <\/em>l&rsquo;activit\u00e9 de location touristique comprend \u00e9galement son interdiction.<\/p>\n\n\n\n<p><strong>2.-<\/strong> La Cour supr\u00eame estime \u00e9galement que l&rsquo;expression <em>\u00ab limiter ou conditionner \u00bb <\/em>\u00e9tablit un cas de moindre intensit\u00e9 (qui correspondrait \u00e0 la condition) et un autre cas de plus grande intensit\u00e9 (la limitation). Ainsi, la norme ayant exprim\u00e9 deux cas, et sur la base de certaines acceptions figurant dans le dictionnaire de l&rsquo;Acad\u00e9mie royale espagnole, elle estime que <em>\u00ab la possibilit\u00e9 de limitation l\u00e9galement conf\u00e9r\u00e9e aux communaut\u00e9s de propri\u00e9taires de limiter l&rsquo;activit\u00e9 des appartements touristiques dans l&rsquo;immeuble peut \u00e9galement impliquer son interdiction totale, qui serait sa limite maximale \u00bb.<\/em><\/p>\n\n\n\n<p><strong>3.-<\/strong> Enfin, la Cour supr\u00eame consid\u00e8re qu&rsquo;il serait \u00ab contradictoire \u00bb de soumettre l&rsquo;interdiction des locations touristiques au r\u00e9gime de l&rsquo;unanimit\u00e9, car cela rendrait impossible l&rsquo;application de l&rsquo;interdiction, \u00e9tant donn\u00e9 qu&rsquo;il suffirait que le propri\u00e9taire du logement qui souhaite exercer cette activit\u00e9 vote contre pour emp\u00eacher l&rsquo;unanimit\u00e9, ce qui viderait de son sens l&rsquo;article 17.12 de la LPH.<\/p>\n\n\n\n<p><strong><strong>Toutefois, la Cour supr\u00eame ne se prononce pas sur la port\u00e9e temporelle de cette interdiction, de sorte qu&rsquo;il faudra, \u00e0 cet \u00e9gard, se r\u00e9f\u00e9rer \u00e0 ce qu&rsquo;\u00e9tablit la jurisprudence mineure. Il convient de souligner que la disposition elle-m\u00eame pr\u00e9cise clairement que les accords adopt\u00e9s dans l&rsquo; n vertu de l&rsquo;article 17.12 de la LPH n&rsquo;auront pas d&rsquo;effet r\u00e9troactif. La Cour provinciale de Malaga adopte la m\u00eame position dans son r\u00e9cent arr\u00eat n\u00b0 9\/2024, rendu le 12 janvier
