{"id":817,"date":"2015-12-08T00:00:00","date_gmt":"2015-12-08T00:00:00","guid":{"rendered":"http:\/\/public.kiboserver.com\/perezdevargas\/mesures-achat-propriete-sur-plan-300x214\/"},"modified":"2022-02-25T17:39:33","modified_gmt":"2022-02-25T17:39:33","slug":"mesures-achat-propriete-sur-plan-300x214","status":"publish","type":"post","link":"https:\/\/perezdevargas.es\/fr\/blog\/mesures-achat-propriete-sur-plan-300x214\/","title":{"rendered":"Nouvelle Loi sur l\u2019aval et l\u2019assurance obligatoire des quantit\u00e9s vers\u00e9es lors de la vente sur plan de propri\u00e9t\u00e9s"},"content":{"rendered":"<p><em>\u00ab\u00a0La Loi 20\/2015, qui d\u00e9roge express\u00e9ment la Loi 57\/68 et modifi\u00e9e la Loi de Planification de la<\/em><br \/>\n<em> construction\u00a0(LOE) entrera en vigueur le 1 janvier 2016 (BOE 15\/07\/2015).\u00bb<\/em><\/p>\n<p>Ladite Loi d\u00e9roge express\u00e9ment la Loi 57\/1968 sur les paiements anticip\u00e9s per\u00e7us lors de la construction et vente de propri\u00e9t\u00e9s. Pour sa part, elle modifie la premi\u00e8re disposition additionnelle de la Loi de Planification de la Construction, en vue de r\u00e9guler dans cette disposition additionnelle les quantit\u00e9s per\u00e7ues en acompte lors de la vente de propri\u00e9t\u00e9s sur plan. C\u2019est-\u00e0-dire, ce qui jusqu\u2019\u00e0 ce jour \u00e9tait contenu dans la Loi 57\/1968 est maintenant r\u00e9git par la LOE.<\/p>\n<p><!--more--><\/p>\n<p>En plus de r\u00e9gir ce qui jusqu\u00b4\u00e0 ce jour figurait dans la Loi 57\/1968, nous voulons signaler les nouveaut\u00e9s suivantes de la premi\u00e8re disposition additionnelle de la LOE en rapport avec la r\u00e9gulation \u00e9tablit dans la Loi 57\/1968:<\/p>\n<p>&#8211; Sont r\u00e9glement\u00e9s avec plus de rigueur les exigences qui doivent r\u00e9unir aussi bien l\u2019assurance-caution que l\u2019aval avec lesquels sont garantit les quantit\u00e9s vers\u00e9es en acompte.<\/p>\n<p>&#8211; \u00c9tablissant express\u00e9ment que si\u00a0 \u00ab\u00a0\u00e0 l\u00b4expiration du d\u00e9lai de deux ans, \u00e0 compter depuis le manquement par le promoteur de l\u2019obligation de garantie, sans que l\u2019acqu\u00e9rant est \u00e9t\u00e9 pr\u00e9alablement requis pour la r\u00e9siliation du contrat et la d\u00e9volution des quantit\u00e9s anticip\u00e9es, la caducit\u00e9 de l\u2019aval se produira.<\/p>\n<p>&#8211; Dans la Loi 57\/1968, il est \u00e9tablit de fa\u00e7on explicite qu\u00b4aussi bien le contrat d\u2019assurance que l\u2019aval, unis au document faisant foi dans lequel s\u00b4accr\u00e9dite la non initiation des travaux ou la remise de la propri\u00e9t\u00e9, aura un caract\u00e8re ex\u00e9cutif selon les effets pr\u00e9vus dans le droit de la proc\u00e9dure civile. C\u2019est-\u00e0-dire, que l\u2019assur\u00e9 pourra accourir \u00e0 la proc\u00e9dure judicaire ex\u00e9cutive, en plus de la proc\u00e9dure ordinaire afin d\u2019exiger \u00e0 l\u2019assureur ou au garant la remise des quantit\u00e9s qui lui sont dut. Or, cette mention du caract\u00e8re ex\u00e9cutif de l\u2019aval et de l\u2019assurance ha disparut dans la LOE. Cela inclus que si l\u2019aval ou l\u2019assurance n\u2019est pas contr\u00f4l\u00e9 par un Notaire, l\u00b4assur\u00e9 pourra<br \/>\nseulement r\u00e9clamer au garant ou \u00e0 l\u2019assureur \u00e0 travers une proc\u00e9dure ordinaire et non pas au travers d\u2019une proc\u00e9dure ex\u00e9cutive.<\/p>\n<p>\u00c0 Marbella, le 21 octobre 2015.<\/p>\n<p>P\u00e9rez de Vargas
